FRS’s “Class Action of the Month” for September 2025 is Sutter Health Indirect

In 2012, a class action lawsuit was filed in the Northern District of California alleging the Defendant, Sutter Health, forced certain pricing and contractual terms upon Aetna, Anthem Blue Cross, Blue Shield of California, Health Net or UnitedHealthcare (the “Health Plans”) thereby causing the Health Plans to pay more than they otherwise would for Sutter’s hospital services. This allegedly resulted in higher insurance premiums for eligible class members, whether or not they used Sutter hospitals, in violation of federal antitrust and state anti-competition laws. If your business paid any portion of premiums for fully-insured health insurance from the Health Plans from January 1, 2011 through March 8, 2021, you may be entitled to participate in the $228.5 MILLION recovered in the class action settlement. The claim filing deadline is September 12, 2025.
